03 Purposes of the data processing, legal bases and legitimate interests pursued by the controller or a third party, as well as categories of recipients

03.1 Calling up our websites/applications

03.1.1 Log files

Each time websites/applications are accessed, information is sent to the server of our website/application by the respective internet browser of your respective end device and temporarily stored in log files. 03.3.1 Google Analytics

We use various information on our pages for marketing purposes. We use the pixel of Meta Platforms Ireland Limited, 4 Grand Canal Square, Dublin, Ireland („Meta“) (website custom audience pixel). SCAYLE maintains social media profiles on the social networks Facebook and Instagram (“Fanpages”), services of Meta Platforms Ireland Limited, 4 Grand Canal Square, Dublin, Ireland („Meta“), on which we regularly publish and share content and offers. When you interact with our fanpages or other Facebook or Instagram websites, the providers of the social networks record your usage behavior with cookies and similar technologies. SCAYLE can view general statistics on the interests and demographic characteristics (such as age, gender, region) of users for its fan pages. If you use social networks, the type, scope and purposes of data processing in the social networks are primarily determined by the providers of the social networks. Usage analysis (Page Insights)

When you interact with our fan pages, Meta records your usage behavior with cookies and similar technologies. In this context, SCAYLE receives “page insights” that contain statistical, non-personalized (anonymized) information about visitors. It is not possible for us to assign this information to you personally. The selection and processing of Page Insights information is done exclusively by Meta. Page insights help us to understand how our fan pages are used, what interests visitors have, and which topics and content are particularly popular. SCAYLE and Meta are jointly responsible for the processing of your data for the provision of Page Insights (Article 26 GDPR). There is an agreement between SCAYLE and Meta that specifies which company fulfills which data protection obligations in accordance with the GDPR with regard to the processing of Page Insights data.

We use the CRM system of Hubspot to process customer inquiries. The provider is Hubspot, a service of HubSpot, 2nd Floor 30 North Wall Quay, Dublin 1, Ireland (“Hubspot”). We use Hubspot to process your requests quickly and efficiently. We have entered into a Data Processing Agreement (DPA) with Hubspot. 04 Processor

In the course of processing your data, we use so-called processors in some areas. A processor is a natural or legal person, authority, institution or other body that processes personal data on our behalf, whereby we remain responsible for the data processing. Processors do not use the data for their own purposes, but carry out data processing exclusively for the controller.

05 Storing and data deletion

SCAYLE will only store personal data for as long as it is necessary for the purposes stated in this Privacy Policy, in particular to fulfill our contractual and legal obligations. If necessary, we will also store your personal data for further purposes, if or as long as the further storage for certain purposes is permitted by law.

If complete deletion is not possible or not required for legal reasons, we block this information. For example, it is blocked if retention obligations under commercial or tax law apply, for example under the German Commercial Code (HGB) and the German Fiscal Code (AO). In this case, we are obliged to retain this information for up to ten years for tax audits and audits. Even if there is no legal obligation to retain data, we may refrain from immediate deletion in certain cases permitted by law. This applies, for example, if the information in question may still be required for further contract processing or legal prosecution or legal defense (e.g. in the case of complaints). With the exception of the processing described above, we do not pass on your data to recipients based outside the European Union or the European Economic Area. The aforementioned processing includes a data transfer to the servers of the providers of tracking and targeting technologies commissioned by us. These servers are located in the USA. The data transfer takes place on the basis of so-called standard contractual clauses of the EU Commission.

In addition to the right to revoke the consent given by you to us, you are entitled to the following further rights if the respective legal requirements are met:

• the right to information SCAYLE personal data stored by us (Art. 15 GDPR), in particular you can request information about the processing purposes, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the origin of your data, if it has not been collected directly from you;
• the right to correct incorrect data or to complete correct data (Art. 16 GDPR), the right to have your data stored by us deleted (Art. 17 GDPR), insofar as no legal or contractual retention periods or other legal obligations or rights to further storage are to be observed by us;
• the right to restrict the processing of your data (Art. 18 GDPR), insofar as the accuracy of the data is disputed by you, the processing is unlawful, but you object to its erasure; the controller no longer requires the data, but you need it for the assertion, exercise or defense of legal claims or you have objected to the processing pursuant to Art. 21 GDPR;
• the right to data portability according to Art. 20 GDPR, i.e. the right to have selected data stored by us SCAYLE transferred in a common, machine-readable format, or to request the transfer to another responsible party;
• the right to lodge a complaint with a supervisory authority. As a rule, you can contact the supervisory authority of your usual place of residence or workplace or our company headquarters.

07.2 Right to object

Under the conditions of Article 21 (1) of the GDPR, data processing may be objected to on grounds relating to the specific situation of the data subject.

The above general right of objection applies to all processing purposes described in this Privacy Notice, which are processed on the basis of Article 6(1)(f) GDPR. Unlike the specific right of objection directed at data processing for promotional purposes, under the GDPR we are only obliged to implement such a general objection if you provide
us with reasons of overriding importance for doing so (e.g. a possible risk to life or health).

07.3 Right of withdrawal

If we process data on the basis of your consent, you have the right to revoke this consent at any time. The revocation of the consent does not have the consequence that the data processing carried out on the basis of the consent up to the time of the revocation becomes ineffective.
